Welcome to Upwardly Math

"These terms explain how Upwardly Math works and what we each agree to. No fine-print traps—just the honest rules of the road."

Upwardly Math ("Upwardly," "we," "us," or "our") is a K–8 math practice service operated by Wilkinson Learning Works, LLC. These Terms of Service (the "Terms") govern your access to and use of our website, app, and related services (together, the "Service").

By creating an account, starting a free trial, or otherwise using the Service, you agree to these Terms and to our Privacy Policy and Refund & Cancellation Policy. If you don't agree, please don't use the Service.

Eligibility

Who Can Use Upwardly Math

  • You must be at least 18 years old and the parent, legal guardian, or authorized educator responsible for the student(s) who will use the Service.
  • Accounts are created and owned by an adult. You can create a simple, parent-controlled login for each student—some families have students sign in with their own student login, others have them use the parent's. Either way, you own and control the account.
  • You agree to provide accurate account information and to keep your login credentials secure.
Your Account

Accounts & Parent Responsibility

You're responsible for activity that happens under your account, including your students' use of the Service. Because you're in control, please:

  • Keep your login credentials confidential and don't share your account outside your household.
  • Supervise how your students use the Service, as you see fit.
  • Let us know promptly if you believe your account has been used without your permission.
Billing

Subscriptions, Free Trial & Billing

This is the part most companies hide. We put it front and center.

Your 7-Day Free Trial

  • New subscriptions start with a 7-day free trial with full access to the catalog. Your card is not charged on the day you sign up.
  • If you cancel before the trial ends, you won't be charged anything.

⚠️ Automatic Renewal — Please Read

Upwardly Math is a subscription that renews automatically until you cancel.

  • When your free trial ends, your subscription automatically converts to a paid plan and your payment method is charged the plan price you selected at sign-up.
  • After that, your subscription renews automatically at the start of each billing cycle (monthly or annually, depending on your plan) at the then-current price, until you cancel.
  • The trial end date, plan price, and billing cycle are shown to you at checkout before you confirm, and again in your confirmation email.

How Payments Are Processed

Payments are handled by Lemon Squeezy, which acts as our authorized reseller and Merchant of Record. Your purchase is also subject to Lemon Squeezy's buyer terms, and your card details are processed securely by Lemon Squeezy—we never see or store them.

Price Changes

If we change the price of your plan, we'll give you advance notice by email before the change applies to your next renewal, so you can decide whether to continue. Continuing your subscription after the effective date means you accept the new price.

Cancellation

Cancelling Your Subscription

No Hoops. Ever.

  • ✓ Manage your subscription yourself from the Subscription tab on your My Account page inside the app—cancel or make any plan change you need, on your own, at any time.
  • ✓ No phone calls, no emails, no "are you sure?" retention maze.
  • ✓ When you cancel, your plan stays active until the end of your current billing cycle, then simply doesn't renew.
  • ✓ You keep full access through the time you've already paid for.

Cancelling stops future renewals. It does not, by itself, refund a charge that has already been made—see our Refund & Cancellation Policy for how refunds work.

Refunds

Refunds

Because your 7-day free trial lets you evaluate Upwardly Math fully at no cost, we generally do not offer refunds on subscription charges, except where required by law. The full details—and the rare exceptions—are in our Refund & Cancellation Policy, which forms part of these Terms.

Fair Use

Acceptable Use

Upwardly Math is for your family's personal learning use. Please don't:

  • • Resell, sublicense, or share paid access outside your household (educators: see our Classrooms & Groups options).
  • • Copy, scrape, or redistribute our content, questions, or curriculum.
  • • Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
  • • Use the Service for anything unlawful or harmful.

We may suspend or close accounts that violate these rules.

Content

Our Content & Your License

The Service—including its curriculum, questions, software, design, and branding—is owned by Wilkinson Learning Works, LLC and protected by intellectual property laws.

While your subscription is active, we grant you a personal, non-transferable license to use the Service for your family's learning. This license ends if your subscription ends or if you breach these Terms.

Your Data

Your Data & Privacy

How we handle your and your students' information is covered in our Privacy Policy. Parents stay in control of student data at all times.

Disclaimers

Educational Tool, Not a Guarantee

Upwardly Math is a supplemental math-practice tool. We work hard to make it effective, but every learner is different, and we can't guarantee specific grades, test scores, or academic outcomes.

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties we haven't expressly made in these Terms. We aim for reliable, uninterrupted access but can't promise the Service will always be error-free or available.

Liability

Limitation of Liability

To the fullest extent permitted by law, Wilkinson Learning Works, LLC and its team won't be liable for indirect, incidental, or consequential damages arising from your use of the Service. Where liability can't be excluded, our total liability is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

Updates

Changes to the Service & These Terms

We may update the Service and these Terms over time. If we make material changes to these Terms, we'll update the "Last Updated" date above and, when the change meaningfully affects your rights, notify you by email. Continuing to use the Service after changes take effect means you accept the updated Terms.

Legal

Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. If a dispute arises, we'd much rather talk it through first—reach out and we'll do our best to make it right.
